1. Acceptance of Terms

Welcome to AI FILMS Studio (the "Platform"). By creating an account or using our Platform, you agree to these Terms and Conditions ("Terms"). These Terms form a legally binding agreement between you and AI FILMS Studio (operated from Wyoming, USA, referred to as "AI FILMS," "we," "us," or "our"). If you do not agree with these Terms, you must not use the Platform. We may update these Terms periodically; continued use of the Platform after updates signifies your acceptance of the revised Terms. Always review the latest Terms before using the Platform.

2. Eligibility and Accounts

• Age Requirement: You must be at least 18 years old to use AI FILMS Studio. If you are between 13 and 17, you may use the Platform only with the involvement and consent of a parent or legal guardian, and only a parent or legal guardian may make a purchase on your behalf. The Platform is not intended for children under 13, and we do not knowingly provide services to or collect data from anyone under 13.
• Account Registration: To access the Platform, you must create an account. You agree to provide accurate, current information (including a valid email) and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
• Account Security: You are responsible for the security of the devices you use with our Platform and for safeguarding your account password. AI FILMS is not liable for loss or damage arising from unauthorized access due to your failure to secure credentials or devices.

3. Subscription and Payment

• Subscriptions, Credit Packs and No Free Tier: AI FILMS Studio offers paid subscription plans and one-time credit pack purchases. Using AI generation features requires a sufficient credit balance obtained through an active paid subscription or a credit pack purchase. No free tier is offered.
• Fees and Billing: Subscription fees are billed in advance and credit pack purchases are billed at the time of purchase, both through Stripe. A subscription renews automatically at the end of each billing period and the plan fee is charged to your payment method again until you cancel; you can cancel at any time as described in Section 16. A credit pack is a one-time purchase and does not renew. All purchases are final and non-refundable, including subscriptions, credit packs, and every other purchase made on the Platform. Failed generations are handled by the automatic credit restoration described in Section 25 (Model-Specific Credit and Refund Policies), which returns credits to your balance and is not a refund of any payment. Nothing in this section limits any right you have under applicable law. All amounts are in U.S. Dollars. For billing issues, contact billing@studio.aifilms.ai before initiating chargebacks.
• Credit Pre-Authorization: Upon a user's submission of any form or initiation of any content generation or other feature available on the AI FILMS Studio platform, AI FILMS Studio may calculate, reserve, and pre-authorize an amount of credits equal to the estimated or applicable cost of such feature. This pre-authorization is intended to ensure uninterrupted execution and to prevent failure of a feature due to an insufficient credit balance. By using the platform, users acknowledge and agree that access to and use of any feature is conditional upon maintaining a sufficient credit balance to cover the full estimated cost of the feature for its entire duration.
• User-Initiated Cancellation of Tasks: If you elect to cancel a content generation request or any feature processing after it has been initiated and credits have been pre-authorized, the pre-authorized credits will not be refunded or returned to your balance. By initiating a task, you acknowledge that the computational resources are allocated immediately and the cost is non-refundable regardless of whether you allow the task to complete.
• Payment Security: AI FILMS Studio uses Stripe as its third-party payment processor. Stripe handles all sensitive payment information on its secure infrastructure; AI FILMS Studio does not store full card numbers. By using the Platform, you agree to Stripe's terms of service and privacy policy. AI FILMS Studio employs commercially reasonable measures to protect transactions, but is not liable for unauthorized access or disclosure of payment data not due to its gross negligence or willful misconduct.
• Credits Validity: (a) Subscription Credits: Credits granted as part of a monthly subscription plan are service entitlements that expire after ninety (90) days from the date of issue and have no cash value. Cancellation of a subscription never removes subscription credits — they remain valid until they reach their own expiry date. (b) Purchased Top-Ups: Credits purchased separately as not part of any subscription (credit packs) are valid for six (6) months from the date of purchase, have no cash value, and cannot be transferred or exchanged for cash. (c) Referral Credits: Credits earned through the referral program are valid for 365 days from the date they are awarded, have no cash value, and cannot be transferred or exchanged for cash. (d) Platform Discontinuation: If AI FILMS Studio permanently discontinues the Platform, we will give at least thirty (30) days' notice so that customers may use their remaining credits. After that date, unused credits end and have no cash value. AI FILMS Studio may modify the credit validity period at its discretion. Users will be notified of changes where reasonably practicable; it remains the user's responsibility to review the most current Terms and Conditions. A change to the credit validity period applies only to credits granted or purchased after the change takes effect. Credits already in your account keep the validity period that applied when they were granted.
• One Active Subscription: Each account supports one active subscription at a time. To change plans, use the Swap Plan option on the Pricing page or from your Profile under the Subscription tab.
• Cooling-Off Period: After a manual cancellation, there is a 30-day waiting period before you can start a new subscription. This cooling-off period does not apply to plan changes made using the Swap Plan feature.

4. Content Ownership and User Rights

• Your Content: You retain full ownership and IP rights to any User Content you create, upload, or import into the Platform, including generated outputs, configurations, workflows, and saved projects. However, the underlying software, algorithms, feature implementations, execution/processing engines, and proprietary logic remain the intellectual property of AI FILMS Studio. You may save, load, edit, duplicate, and delete your content and configurations at any time. You may not reverse engineer or attempt to extract proprietary logic from any Platform feature.
• Commercial Use: All users may commercially exploit their creations generated with AI FILMS Studio, subject to these Terms and applicable law.
• Import/Export Freedom: You may freely import assets and export projects---your work is never locked in.

5. License Grant to AI FILMS Studio

By using the Platform and uploading User Content, you grant AI FILMS a limited, non-exclusive, worldwide, royalty-free license to host, process, display, and back up your content as necessary to operate and improve the Platform. With your permission, we may showcase anonymized examples for marketing. You continue to own your content.

6. Platform Intellectual Property

All rights to the Platform's software, AI models, design, and trademarks belong to AI FILMS or its licensors. You receive a limited license to use the Platform; no ownership is transferred.

7. Acceptable Use Policy

You agree not to misuse the Platform. Prohibited conduct includes impersonation, unlawful activity, obscene or infringing content, privacy violations, malicious code, spam, and interference with others. Violations may lead to content removal or account termination without refund.
• Sanctions and Export Control: You represent that you are not located in, and are not a resident of, a country subject to a United States embargo, and that you are not on any United States restricted-party list. You may not use the Platform in breach of United States export control or sanctions law. We may refuse or cancel any purchase and terminate any account for this reason.

8. Community Guidelines

AI FILMS Studio fosters a respectful creator environment. Users must:
• Treat others courteously
• Avoid hate speech, harassment, or doxxing
• Post only content they hold rights to
• Refrain from spam
Violations may result in warnings, credit loss, suspension, or termination.

9. Blocked Content Policy

Prohibited content includes:
• Illegal content (child sexual abuse, bestiality, terrorist instructions)
• Hate speech or harassment of protected classes
• Graphic violence or self-harm encouragement
• Pirated or unlicensed material
• Personal data without consent
Report violations to abuse@studio.aifilms.ai. Repeated breaches result in permanent ban.

10. Content Removal & Complaint Policy

Email help@studio.aifilms.ai with contact info, URL, and reason. We respond within 72 hours and aim to resolve within 7 business days. One appeal allowed.
Intimate images published without consent
If an intimate visual depiction of you appears on the Platform and you did not consent to it, you may ask us to remove it. This applies to a real depiction and to one created or altered by software, including AI.
Send the request to notification@aifilms.ai and include all of the following:
1. Your physical or electronic signature.
2. Identification of the depiction, and enough information for us to find it, such as the page address or the file link.
3. A brief statement that you (or the person you act for) have a good faith belief that the depiction is not consensual, including any information that helps us determine it was published without consent.
4. Contact information, so that we can reach you.
We remove the depiction within 48 hours of a valid request. We also make reasonable efforts to find and remove identical copies. We may remove a depiction while we review the request.
This route is only for intimate images published without consent. Every other content complaint follows the process above.

12. User Responsibilities and Warranties

You warrant that you have rights to your content and that your use complies with law and these Terms. You indemnify AI FILMS against claims arising from your content or misuse.

13. Referral Program

Referral credits are in-platform, have no cash value, expire after 365 days from the date they are awarded, and may change. Abuse voids credits and may lead to account action.

14. Underage & Age-Gating Policy

Service not for children under 13. Users 13-17 require parental consent and may use the Platform only with a parent or legal guardian's involvement; only a parent or legal guardian may make a purchase on their behalf. Age-restricted features require 18+ verification. Misrepresentation leads to account deletion.

15. Support and Communication

Support is provided via in-app tools or email. By using the Platform you consent to receive essential service and billing emails.

16. Termination of Service

You may cancel at any time via Profile → Subscription → Cancel Subscription and confirm. Cancellation takes effect immediately — your account is downgraded to guest status and your credits remain valid until they expire on their own schedule. No refunds are issued for any unused portion of the subscription period. AI FILMS may suspend or terminate accounts for violations; the same immediate-effect rule applies, and a suspension for a breach of these Terms may also remove your remaining credits, with no refund. Deleting your account cancels your subscription. If that automatic cancellation fails, we cancel it manually. Deleting your account permanently removes all remaining credits.

17. Disclaimers of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind.

18. Limitation of Liability

AI FILMS's total liability is limited to the fees you paid in the previous 12 months, or $100 if no fees were paid, to the extent permitted by law. This limit does not apply to harm that we cause intentionally or recklessly, or to any liability that the law does not allow us to limit.

19. Indemnification

You agree to indemnify and hold AI FILMS harmless from claims related to your content or misuse of the Platform.

20. Governing Law and Jurisdiction

These Terms are governed by Wyoming and U.S. federal law, and the Federal Arbitration Act governs the arbitration agreement in Section 29. Disputes are resolved as Section 29 (Dispute Resolution & Arbitration) provides. A dispute that Section 29 does not require to be arbitrated, and an action to enforce an arbitration award, may be brought only in the state or federal courts located in Wyoming, USA, except where Section 29 allows a court of competent jurisdiction.

21. No Waiver; Severability

Failure to enforce any provision is not a waiver. If any provision is unenforceable, the remainder remains in effect.

22. Changes to These Terms

Material changes will be communicated; continued use constitutes acceptance of any revisions. Purchases made before the Effective Date are governed by the Terms in force at the time of purchase.

23. Entire Agreement

These Terms, the Privacy Policy, and posted guidelines constitute the entire agreement between you and AI FILMS Studio.

25. Model-Specific Credit and Refund Policies

1. System Failures (Credit Restoration): Credits are automatically restored to your balance when a request fails due solely to system errors originating within our platform. This restores credits already spent and is not a refund of any payment. Once fail-over APIs are implemented, credits will be restored only for failures originating solely in our system.
2. Prompt Parameters: Our integration may reject prompts containing specific flags. The respective AI Generator contains a list of these disallowed flags. Failures occuring from adding said flags will not be refunded.
3. Kling LipSync Generations: If the provided dubbing audio or URL exceeds 5 seconds, the external service may ignore it, and the generation may omit the intended dubbing. Credits will be charged as long as the generation completes, even if the model downgrades (e.g., fallback to another model).
4. Image Generation Routing: Approximately 1% of image requests may be fulfilled with alternative models due to provider routing.
5. Cost Variability: Credit costs per generation are not fixed. They vary by model, by settings such as duration and resolution, and by provider changes, and we may change them at any time without prior notice. The cost shown at the moment you submit a request is the cost charged for that request. A cost seen in an earlier session is not a guarantee of a future cost.
6. Credit Cost Corrections: If a verifiable system error causes the credits taken for a request to differ from the cost shown when you submitted it, we correct your balance by restoring the difference. This restores credits already spent and is not a refund of any payment. Report a suspected error to billing@studio.aifilms.ai.

26. Billing Policy Transparency

Subscription Model and Payment Processing: AI FILMS Studio operates on prepaid subscription plans and one-time credit pack purchases processed through Stripe. All fees are final, non-refundable and billed in USD.
Subscription Process:
1. Visit https://studio.aifilms.ai
2. Click "Start Creating".
3. Sign up or sign in and accept these Terms and the Privacy Policy.
4. Choose a plan at https://studio.aifilms.ai/pricing
5. Confirm payment.
6. Receive Stripe invoice and confirmation email.
Unsubscription Process:
Cancellation takes effect immediately. Path: Profile → Subscription → Cancel Subscription → Confirm. Credits remain valid until their own expiry date. Deleting your account cancels your subscription; if that automatic cancellation fails, we cancel it manually. Deleting your account permanently removes all remaining credits.
Account Deactivation:
Deactivating an account does not cancel a subscription unless you also unsubscribe via the steps above.
Chargebacks and Dispute Resolution:
AI FILMS Studio is committed to resolving billing issues amicably. Users should contact customer support before initiating a chargeback. AI FILMS Studio maintains transaction records to investigate disputes. All purchases are final and non-refundable. AI FILMS Studio may suspend or terminate accounts to protect its interests during a dispute, including freezing the account's credit balance and pausing new purchases while a dispute is open, or if the dispute is resolved against the account holder.
System Error Corrections:
Notwithstanding the general no-refund policy, where a verifiable system or payment-processing error results in a duplicate or otherwise unintended charge — for example, two identical subscriptions arising from a single purchase attempt — AI FILMS Studio will, upon detection or upon a verified customer report, cancel the erroneous subscription or transaction and reverse the associated charge to the original payment method. Such reversals are corrections of error initiated by AI FILMS Studio; they do not constitute refunds within the meaning of this policy and create no entitlement to refunds in any other circumstance. Any credits granted as a result of the erroneous charge are void upon reversal; credits attributable to valid charges are unaffected. Suspected duplicate or erroneous charges should be reported to billing@studio.aifilms.ai before initiating any bank or card-network dispute, and AI FILMS Studio will investigate and resolve verified reports promptly.
Subscription Management and Account Integrity:
AI FILMS Studio reserves the right to monitor account activity and take appropriate action, including temporary suspension or permanent deactivation, for behavior deemed fraudulent, abusive, or in violation of these Terms. This includes, but is not limited to, attempts to circumvent subscription limitations or engage in unauthorized access. AI FILMS Studio retains sole discretion in determining such activity and the appropriate course of action. If we lift a suspension because it was applied in error, we restore the account's credit balance in full and extend the validity period of those credits by the length of the suspension.

27. Accessibility Statement

We aim for WCAG 2.2 AA conformance. If you encounter barriers, email help@studio.aifilms.ai; we respond within 5 business days.

28. Section 2257 Exemption Statement

18 U.S.C. §2257 Exemption Statement: AI FILMS Studio hosts no actual sexually explicit depictions; therefore §2257 record-keeping does not apply. If explicit content is ever allowed, we will comply with all record-keeping duties.

29. Dispute Resolution & Arbitration

1. Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration conducted by the American Arbitration Association (AAA) in accordance with the AAA rules that apply to the dispute under the AAA's own scope rules (for an individual who uses the Platform, the AAA Consumer Arbitration Rules). A hearing may be held by videoconference, by telephone, or on documents alone, and the place of any in-person hearing is set under those AAA rules. The AAA fee schedule that applies to the dispute decides who pays the arbitration fees: for an individual under the Consumer Arbitration Rules the filing fee is capped, and AI FILMS Studio pays the other AAA fees and the arbitrator's compensation. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
2. Class Action Waiver: You and AI FILMS Studio agree to resolve any disputes on an individual basis only. You explicitly waive your right to participate in, bring, or maintain a class action lawsuit, class-wide arbitration, or any representative or collective proceeding against AI FILMS Studio. This waiver applies even if the AAA's rules or procedures would otherwise permit class arbitration.
3. Exceptions: Either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights. Small claims court proceedings (up to the jurisdictional limit) are also exempt from mandatory arbitration.
4. Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to help@studio.aifilms.ai within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement.

30. Privacy & Data Rights

1. Privacy Policy: AI FILMS Studio's data collection, use, and sharing practices are governed by our Privacy Policy, available at https://studio.aifilms.ai/privacy-policy. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.
2. State Privacy Rights: Residents of California, Virginia, Colorado, Connecticut, Utah, and other states with comprehensive privacy laws have specific rights regarding their personal data, including the right to request access to, correction of, deletion of, or portability of personal information. California residents additionally have the right to opt out of the sale or sharing of personal data and to limit the use of sensitive personal information. To exercise these rights, email support@studio.aifilms.ai with "Privacy Rights Request" in the subject line. We will respond within the timeframes required by applicable state law.
3. Biometric Information: Certain Platform features may analyze facial geometry, voice characteristics, or other biometric identifiers to generate AI content (e.g., facial animation, voice cloning, lip synchronization). By using such features, you explicitly consent to the collection and processing of biometric information solely for the purpose of content generation. AI FILMS Studio does not store biometric templates, voiceprints, or facial scans after the generation process is complete. Biometric data is processed in accordance with applicable laws, including the Illinois Biometric Information Privacy Act (BIPA), Texas Capture or Use of Biometric Identifier Act (CUBI), and similar state statutes. You represent and warrant that you have obtained all necessary consents from any individuals whose biometric information you submit to the Platform.
4. Do Not Sell or Share: AI FILMS Studio does not sell personal data to third parties. We may share data with service providers and partners as described in our Privacy Policy. California residents may submit "Do Not Sell or Share" requests at any time by emailing support@studio.aifilms.ai.
5. Children's Privacy: As stated in Section 2, the Platform is not intended for children under 13, and we do not knowingly collect personal information from children under 13. Users aged 13-17 must have parental or guardian consent. If we become aware that we have collected personal information from a child under 13 without verification of parental consent, we will delete that information promptly.
