1. Acceptance of Terms
Welcome to AI FILMS Studio (the "Platform"). By creating an account or using our Platform, you agree to these Terms and Conditions ("Terms"). These Terms form a legally binding agreement between you and AI FILMS Studio (operated from Wyoming, USA, referred to as "AI FILMS," "we," "us," or "our"). If you do not agree with these Terms, you must not use the Platform. We may update these Terms periodically; continued use of the Platform after updates signifies your acceptance of the revised Terms. Always review the latest Terms before using the Platform.
2. Eligibility and Accounts
• Age Requirement: You must be at least 18 years old to use AI FILMS Studio. If you are between 13 and 18, you may use the Platform only with the involvement and consent of a parent or legal guardian. The Platform is not intended for children under 13, and we do not knowingly provide services to or collect data from anyone under 13.
• Account Registration: To access the Platform, you must create a subscription account. You agree to provide accurate, current information (including a valid email) and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
• Account Security: You are responsible for the security of the devices you use with our Platform and for safeguarding your account password. AI FILMS is not liable for loss or damage arising from unauthorized access due to your failure to secure credentials or devices.
3. Subscription and Payment
• Subscription Only -- No Free Tier: AI FILMS Studio is a subscription-based service. Access requires an active paid subscription. No free tier is offered.
• Fees and Billing: Subscription fees are billed in advance through Stripe and are non-refundable, except where required by law. All amounts are in U.S. Dollars.
• No Refund Policy: All payments are final. Subscriptions are prepaid and non-refundable. Cancelling stops future charges but does not refund unused time. For billing issues, contact billing@studio.aifilms.ai before initiating chargebacks.
• Payment Security: AI FILMS Studio uses Stripe as its third-party payment processor. Stripe handles all sensitive payment information on its secure infrastructure; AI FILMS Studio does not store full card numbers. By using the Platform, you agree to Stripe's terms of service and privacy policy. AI FILMS Studio employs commercially reasonable measures to protect transactions, but is not liable for unauthorized access or disclosure of payment data not due to its gross negligence or willful misconduct.
• Credits Validity: User credits obtained through a subscription are valid for 90 days from the date of purchase, unless otherwise specified. Credits expire after 90 days of inactivity and have no cash value. AI FILMS Studio may modify the credit validity period at its discretion. Users will be notified of changes where reasonably practicable; it remains the user's responsibility to review the most current Terms and Conditions.
4. Content Ownership and User Rights
• Your Content: You retain full ownership and IP rights to any User Content you create, upload, or import into the Platform.
• Commercial Use: All users may commercially exploit their creations generated with AI FILMS Studio, subject to these Terms and applicable law.
• Import/Export Freedom: You may freely import assets and export projects---your work is never locked in.
5. License Grant to AI FILMS Studio
By using the Platform and uploading User Content, you grant AI FILMS a limited, non-exclusive, worldwide, royalty-free license to host, process, display, and back up your content as necessary to operate and improve the Platform. With your permission, we may showcase anonymized examples for marketing. You continue to own your content.
6. Platform Intellectual Property
All rights to the Platform's software, AI models, design, and trademarks belong to AI FILMS or its licensors. You receive a limited license to use the Platform; no ownership is transferred.
7. Acceptable Use Policy
You agree not to misuse the Platform. Prohibited conduct includes impersonation, unlawful activity, obscene or infringing content, privacy violations, malicious code, spam, and interference with others. Violations may lead to content removal or account termination without refund.
9. Blocked Content Policy
Prohibited content includes:
• Illegal content (child sexual abuse, bestiality, terrorist instructions)
• Hate speech or harassment of protected classes
• Graphic violence or self-harm encouragement
• Pirated or unlicensed material
• Personal data without consent
Report violations to abuse@studio.aifilms.ai. Repeated breaches result in permanent ban.
10. Content Removal & Complaint Policy
Email help@studio.aifilms.ai with contact info, URL, and reason. We respond within 72 hours and aim to resolve within 7 business days. One appeal allowed.
11. DMCA Copyright Policy
Notice requirements under 17 U.S.C. §512:
1. Signature of copyright owner or authorized agent
2. Work identification
3. Infringing URL or location
4. Contact information
5. Good-faith statement
6. Accuracy statement under penalty of perjury
Send to help@studio.aifilms.ai. Counter-notice per §512(g). Repeat infringers terminated.
12. User Responsibilities and Warranties
You warrant that you have rights to your content and that your use complies with law and these Terms. You indemnify AI FILMS against claims arising from your content or misuse.
13. Referral Program
Referral credits are in-platform, have no cash value, expire after 90 days of inactivity, and may change. Abuse voids credits and may lead to account action.
14. Underage & Age-Gating Policy
Service not for children under 13. Users 13-17 require parental consent. Age-restricted features require 18+ verification. Misrepresentation leads to account deletion.
15. Support and Communication
Support is provided via in-app tools or email. By using the Platform you consent to receive essential service and billing emails.
16. Termination of Service
You may cancel at any time via Profile → Unsubscribe → Confirm; service remains active until the paid term ends. AI FILMS may suspend or terminate accounts for violations. No refunds on termination. Deleting an account does not cancel a subscription.
17. Disclaimers of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind.
18. Limitation of Liability
AI FILMS's total liability is limited to the fees you paid in the previous 12 months, or $100 if no fees were paid, to the extent permitted by law.
19. Indemnification
You agree to indemnify and hold AI FILMS harmless from claims related to your content or misuse of the Platform.
20. Governing Law and Jurisdiction
These Terms are governed by Wyoming and U.S. federal law. Disputes are resolved exclusively in the courts of Wyoming, USA.
21. No Waiver; Severability
Failure to enforce any provision is not a waiver. If any provision is unenforceable, the remainder remains in effect.
22. Changes to These Terms
Material changes will be communicated; continued use constitutes acceptance of any revisions.
23. Entire Agreement
These Terms, the Privacy Policy, and posted guidelines constitute the entire agreement between you and AI FILMS Studio.

25. Model-Specific Credit and Refund Policies
1. LLM Basic Completion Requests: Costs accrue once the request is submitted to the external provider. Credits are refunded only if a failure occurs within our system during submission. Failures occurring on third-party systems after successful submission from our systems are not refunded.
2. All Other Model Requests: Credits are automatically refunded when a request fails within our system. Once fail-over APIs are implemented, refunds will be issued only for failures originating solely in our system.
3. Midjourney Prompt Parameters: Our integration may reject prompts containing specific flags. The respective AI Generator contains a list of these disallowed flags. Failures occuring from adding said flags will not be refunded.
4. Kling LipSync Generations: If the provided dubbing audio or URL exceeds 5 seconds, the external service may ignore it, and the generation may omit the intended dubbing. Credits will be charged as long as the generation completes, even if the model downgrades (e.g., fallback to another model).
5. GPT-4o Image Generation Routing: Approximately 1% of GPT-4o image requests may be fulfilled with OpenAI's DALL-E model due to provider routing. Credits are charged at the GPT-4o rate.
26. Billing Policy Transparency
Subscription Model and Payment Processing: AI FILMS Studio operates on prepaid subscription plans processed through Stripe. Fees are non-refundable and billed in USD.
Subscription Process:
1. Visit https://studio.aifilms.ai
2. Click "Start Creating".
3. Sign up or sign in and accept these Terms and the Privacy Policy.
4. Choose a plan at https://studio.aifilms.ai/pricing
5. Confirm payment.
6. Receive Stripe invoice and confirmation email.
Unsubscription Process (cancels future billing):
Cancellation path: Profile → Unsubscribe → Confirm. Deleting an account does not cancel a subscription.
Account Deactivation:
Deactivating an account does not cancel a subscription unless you also unsubscribe via the steps above.
Chargebacks and Dispute Resolution:
AI FILMS Studio is committed to resolving billing issues amicably. Users should contact customer support before initiating a chargeback. AI FILMS Studio maintains transaction records to investigate disputes. Fees are generally non-refundable; any refund or credit is at AI FILMS Studio's sole discretion. AI FILMS Studio may suspend or terminate accounts to protect its interests during a dispute.
Subscription Management and Account Integrity:
AI FILMS Studio reserves the right to monitor account activity and take appropriate action, including temporary suspension or permanent deactivation, for behavior deemed fraudulent, abusive, or in violation of these Terms. This includes, but is not limited to, attempts to circumvent subscription limitations or engage in unauthorized access. AI FILMS Studio retains sole discretion in determining such activity and the appropriate course of action.
27. Accessibility Statement
We aim for WCAG 2.2 AA conformance. If you encounter barriers, email help@studio.aifilms.ai; we respond within 5 business days.
28. Section 2257 Exemption Statement
18 U.S.C. §2257 Exemption Statement: AI FILMS Studio hosts no actual sexually explicit depictions; therefore §2257 record-keeping does not apply. If explicit content is ever allowed, we will comply with all record-keeping duties.
